Terms of Use – Ascend Saunas

Welcome to Ascend Saunas. These Terms of Use ("Terms") govern your access to and use of our website, booking platform, mobile sauna and ice bath services, and any other services or products we provide. By visiting our website or engaging with our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.

By signing below or by proceeding to book or use any service provided by Ascend Saunas, you confirm the following:

1. You have read, understood, and agree to be bound by Ascend Saunas’ Terms of Use.

2. You acknowledge that sauna and ice bath use involves exposure to extreme temperatures and may pose risks to individuals with certain medical conditions.

3. You confirm that you are physically fit to participate in sauna and cold immersion experiences and take full responsibility for your own health and safety.

4. You agree to follow all health, safety, and conduct instructions given by Ascend Saunas personnel.

5. You release Ascend Saunas from any liability for injury or harm unless caused by proven gross negligence.

6. You agree to the booking, payment, refund, and cancellation policies as outlined in the Terms of Use.

7. You understand and accept that all participation is at your own risk and that sessions are limited as per your membership.

8. You understand the no-show and late cancellation policy, including the possibility of incurring a fee or forfeiting a session credit.

9. You understand that your data may be collected and used in line with the Ascend Saunas Privacy Statement.

10. You acknowledge that personal devices such as phones, smartwatches, or fitness trackers are brought into the sauna or ice bath area at your own risk. Ascend Saunas is not responsible for any loss, theft, damage, or malfunction of personal devices due to heat, water, or misuse.

Ascend Saunas is a mobile wellness service operating across the Gold Coast, Queensland, offering guided sauna and ice bath experiences in nature-integrated outdoor environments. Our focus is to promote health, recovery, and wellbeing through the use of proven heat and cold exposure techniques delivered safely and accessibly.

2. Acceptance of Terms

By accessing our website, booking a session, becoming a member, or participating in any event hosted by Ascend Saunas, you agree to comply with these Terms and all relevant laws and regulations. Users under the age of 18 must have a parent or legal guardian’s consent to participate.

3. Health and Safety Disclaimer

3.1 Medical Suitability
Sauna and cold immersion therapy involve exposure to extreme temperatures and may not be suitable for individuals with certain health conditions. These include but are not limited to:

• Cardiovascular conditions

• High/low blood pressure

• Pregnancy

• Respiratory illness

• Epilepsy or other seizure disorders

3.2 Personal Risk & Acknowledgement
By engaging in Ascend Saunas services, you confirm you are medically fit and do so at your own risk. Ascend Saunas disclaims liability for any adverse health outcomes unless directly caused by verified negligence.

3.3 Staff Authority & Participant Behaviour
Our staff may refuse service or remove any participant who appears unwell, intoxicated, unsafe, or disruptive. Participants must follow all safety instructions and conduct themselves respectfully at all times.

4. Bookings & Payment

4.1 Online Booking
Bookings must be made through our authorised system (e.g., Momence). You agree to provide accurate and truthful information during the booking process.

4.2 Payment Terms
All bookings must be prepaid. Accepted methods include debit/credit card and other payment methods listed on our site. Membership payments are processed on a recurring basis, subject to the terms agreed upon at sign-up.

4.3 Confirmation and Records
Booking confirmations will be sent via email. It is your responsibility to ensure all booking details are correct.

5. Cancellations, Rescheduling & Refunds

5.1 Customer-Initiated Cancellations
To cancel or reschedule without penalty, you must provide a minimum of 24 hours' notice. Late cancellations or no-shows may incur a fee or result in forfeiture of session credit.

5.2 Provider-Initiated Cancellations
Ascend Saunas may cancel or reschedule services due to weather, safety risks, or operational constraints. In such cases, you will receive a credit or alternative booking.

5.3 Refund Policy
Refunds are granted at our discretion and generally only in the case of errors or cancellations initiated by Ascend Saunas.

6. Memberships

6.1 Access and Benefits
Memberships offer recurring access to our services at discounted rates. Terms specific to each membership tier will be provided upon purchase.

6.2 Membership Conduct and Use
Members must:

• Keep contact and billing information up to date

• Adhere to session etiquette and safety rules

• Not share access privileges with others

6.3 Suspension and Termination
We reserve the right to suspend or terminate memberships for misconduct, policy violations, or overdue payments.

7. Code of Conduct

By using our services, you agree to:

• Arrive on time

• Wear appropriate swimwear

• Bring personal towels

• Follow staff guidance

• Avoid inappropriate, aggressive, or disruptive behaviour

• Maintain hygiene and hydration

• Refrain from filming or mobile phone use during sessions

Use of oils, alcohol, drugs, or unsafe behaviour may result in immediate removal without refund.

8. Facility & Service Conditions

Participants must:

• Shower before using the ice bath

• Sit on a towel while in the sauna

• Keep head above water during ice bath use

• Limit sauna use to 20 minutes per round, with at least a 10-minute break between rounds

• Refrain from entering the facilities under the influence of drugs or alcohol

• Be 18 years or older unless accompanied by a parent/guardian

We recommend using the sauna and ice bath in the presence of another person and staying hydrated throughout.

9. Intellectual Property

All content on Ascend Saunas platforms—including branding, copy, images, and designs—is protected intellectual property. No material may be copied, reproduced, or reused without prior written permission.

10. Privacy Policy

Ascend Saunas complies with all Australian privacy legislation. We collect and use personal information in line with our published Privacy Statement. You may review the full policy on our website.

11. Limitation of Liability

To the fullest extent allowed by law, Ascend Saunas shall not be liable for any injury, loss, or damage incurred during your participation unless it arises from proven gross negligence. Our liability is capped at 20% of the Contract Price or value of the booked session.

12. Indemnification

You agree to indemnify Ascend Saunas, its employees, agents, and representatives from any claim, loss, or damage resulting from:

• Your use or misuse of the services

• Your breach of these Terms

• Any inaccurate information you provide

• Any unlawful or negligent acts on your part

This clause does not exclude liability resulting from reckless conduct or that which cannot be lawfully excluded.

13. Suspension and Termination

13.1 Suspension
You may suspend your membership with 7 days’ written notice. Suspension must be for a minimum of 14 days and may not exceed 90 days in a calendar year.

13.2 Termination
To cancel your membership, written notice must be submitted to [Insert Contact Email]. Termination takes effect 30 days from written notice. Final payment will be processed to cover this period.

14. Use & No-Show Policy

14.1 Session Limits
Each member is entitled to one sauna/ice bath session per day under their plan. This ensures fair access for all members.

14.2 No-Show and Late Cancellations
A $10 fee or session credit forfeiture may apply for no-shows or cancellations made less than six hours before the scheduled session.

15. General

15.1 Applicable Law
These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the non-exclusive jurisdiction of the Queensland courts.

15.2 Waiver
No waiver of any provision of these Terms is valid unless in writing.

15.3 Severability
If any provision is found to be unenforceable, the remainder will remain in full force and effect.

15.4 Assignment
Clients may not assign or transfer their rights under these Terms without our written consent. Ascend Saunas may assign or transfer these Terms at its discretion.

15.5 Survival
Any clause which by its nature should survive termination (including liability, indemnity, and privacy terms) will remain in effect.
